The terms that govern use of the Skill Chamber website and free services.

1. Introduction
Welcome to Skill Chamber ("we," "our," "us"). These Terms of Service ("Terms") govern your use of our website (www.skillchamber.com), our free resources such as blog posts, demo requests and general inquiries, and your general interactions with Skill Chamber.
By accessing or using our website or free services, you agree to these Terms. If you do not agree, please do not use our services.
Note: These Terms do not apply to client applications such as isolated platforms for schools, academies or training providers. Those services are governed by separate contractual agreements, including a Data Processing Agreement (DPA).
2. Scope: What These Terms Cover
Website visitors are governed by these Terms together with the Privacy Policy and Cookie Policy, covering general use, data collection and cookies.
Paying clients are governed by a Master Services Agreement (MSA) and a Data Processing Agreement (DPA), covering contractual obligations, data processing and security.
AI usage is covered by our AI Transparency statement, which explains how we use AI responsibly.
3. Acceptable Use
You agree to use our website and free services only for lawful purposes and in compliance with these Terms. You must not:
- Violate any applicable laws or regulations (e.g., GDPR, copyright, fraud)
- Impersonate any person or entity
- Interfere with or disrupt our services (e.g., hacking, DDoS attacks, scraping)
- Upload or share malicious content (e.g., viruses, harmful code)
- Use our services for high-risk automated decision-making (e.g., grading, hiring, legal judgments)
- Abuse, harass, or spam others through our platform
Consequences: We may suspend or terminate your access if you violate these Terms.
4. Data Protection and Privacy
For Website Visitors
We collect and process your data as described in our Privacy Policy. Legal bases for processing include consent (e.g., cookies, newsletter sign-ups), legitimate interest (e.g., analytics, security), and contractual necessity (e.g., responding to demo requests).
Your rights under GDPR include the right to access, rectify, erase or restrict your data, withdraw consent, request data portability, and lodge a complaint with a Data Protection Authority. To exercise your rights, contact us using the details in section 10.
For Paying Clients
Your use of our client applications is governed by your Master Services Agreement (MSA) and Data Processing Agreement (DPA). These agreements include:
- Role clarity: Skill Chamber acts as the Data Processor, while your institution remains the Data Controller (per GDPR Art. 28)
- Purpose limitation: We process data only as instructed by you and for the explicit purposes outlined in your contract
- Security measures: Industry-standard protections, including encryption (TLS 1.2+, AES-256), access controls (MFA, role-based permissions), and regular audits
- International transfers: Appropriate safeguards, such as EU Standard Contractual Clauses (SCCs) plus supplementary measures (e.g., encryption, pseudonymization) for transfers outside the EEA
- Breach notification: 24-hour detection, with 72-hour reporting to your designated contact
- Data retention: Configurable by you (default: 12 months for inactive users)
- Sub-processor transparency: We disclose all third-party providers (e.g., cloud hosting, AI services) in your DPA and notify you of any changes

Security Note: While we take industry-standard measures to protect your data, no system is 100% secure. You are responsible for safeguarding your own credentials (e.g., passwords).
5. AI Usage and Responsibilities
How We Use AI
Our AI supports language learning, feedback, and practice, but does not replace human oversight. AI is advisory only: it does not make high-risk decisions (e.g., grading, hiring, legal judgments). Your data stays in your environment, and conversations and inputs are not used to train our models or third-party foundation models (e.g., OpenAI, Anthropic) unless explicitly agreed in writing.
For Educators and Institutions
- You retain control: AI outputs are tools for your judgment, not final decisions
- Supervision is key: We encourage human review of AI-generated feedback
- Customization: You can tailor scenarios and content to your needs
Transparency
We clearly indicate when you are interacting with AI (e.g., chatbots, feedback tools). AI responses may occasionally be incomplete or imprecise, so always verify critical information. Learn more in our AI Transparency statement.
6. Intellectual Property
Skill Chamber platform: We own all IP rights. You may not copy, modify, or distribute it without our written permission.
Your content: You retain ownership. You grant us a limited license to process and display your content only to provide the services.
AI-generated outputs: You own the outputs. We do not claim ownership of your AI-generated content.
Prohibited: Using our branding (logo, name) without permission.
7. Disclaimers and Limitations of Liability
Disclaimers
- As is, as available: Our services are provided "as is" and "as available". We do not guarantee they will be error-free, uninterrupted, or meet your specific needs
- No professional advice: Our AI and tools are not a substitute for professional advice (e.g., legal, medical, financial)
- AI limitations: AI outputs may contain errors, biases, or outdated information. Always verify critical decisions
Limitations of Liability
To the fullest extent permitted by law, Skill Chamber shall not be liable for indirect, incidental, or consequential damages (e.g., lost profits, data loss), or damages arising from your misuse of our services, unauthorized access to your data (unless due to our gross negligence), or AI-generated content, for which you are responsible for reviewing and validating outputs.
Maximum liability: Our total liability under these Terms shall not exceed 1,000 euros or the fees you paid us in the last 12 months, whichever is higher.
8. Termination
By you: You may stop using our services at any time.
By us: We may suspend or terminate your access if you violate these Terms (e.g., illegal activity, abuse), pose a security risk (e.g., hacking attempts), or are inactive for 12 or more months (for free accounts).
Effect: Upon termination, we delete your data as described in our Privacy Policy, unless required by law to retain it.
9. Changes to These Terms
We may update these Terms from time to time (e.g., for legal or operational reasons). We will post changes on this page with a revised effective date. If you continue using our services after changes are posted, you accept the new Terms.
